Article 1 – Definitions

blinq: the trade name of Trescom BV, established in Edegem, Belgium.

Customer: the natural person who is not acting in the exercise of a profession or business (consumer) and enters into an agreement with blinq.

Products: all electronic and non-electronic personal care products, oral hygiene products and the associated accessories offered by blinq.
Article 2 – Applicability

These general terms and conditions apply to every offer, quotation and concluded agreement with respect to products and/or services offered by blinq via the webshop or affiliated sales channels.

These general terms and conditions apply to the strict exclusion of the general (purchasing) conditions of the customer.

Before the distance contract is concluded, the text of these general terms and conditions is made available to the customer.
Article 3 – Offers and Prices

All prices in the webshop are stated in euros (€), inclusive of VAT and exclusive of any shipping costs. If blinq announces a price reduction (discount), the stated reference price ("from-price") is the lowest price that blinq has applied for that specific product during a period of at least 30 days prior to the introduction of the price reduction.

Any shipping costs are clearly communicated to the customer before completing the order.

Obvious errors, printing errors or typographical errors in the offer, product descriptions or stated prices on the website do not bind blinq. blinq reserves the right to cancel orders placed on the basis of a clear price or specification error at any time and to return the purchase amount immediately.
Article 4 – Delivery

blinq will exercise the greatest possible care when receiving and executing orders.

The stated delivery times (30 days) serve as an indicative target and never as a firm deadline.

The risk of damage, loss or destruction of the products officially transfers to the customer at the moment the products are physically delivered to the stated delivery address by the logistics partner. From that moment, the customer is the owner and bears the risk of storage themselves.
Article 5 – Right of Withdrawal and Exception (Hygiene)

The customer has the right to withdraw from the agreement within a reflection period of 14 calendar days without giving reasons.

Important exception due to hygiene: Products that are not suitable for return for reasons of health protection or hygiene, and whose seal (including but not limited to: the plastic shrink wrap or seal around the packaging) has been broken after delivery, are entirely excluded from the right of withdrawal. If the customer removes or damages this seal, the right of return lapses immediately.

The direct costs of returning products in the event of withdrawal are entirely at the customer's expense.

In accordance with European consumer legislation, blinq offers the customer the possibility to exercise the right of withdrawal directly and digitally via the specific withdrawal button ("Cancel order") on the website. After using this feature, the customer immediately receives an electronic confirmation of the withdrawal.
Article 6 – Legal Guarantee

In accordance with European and Belgian legislation, the customer enjoys a legal guarantee of 2 years for conformity defects of the products.

If a product shows a defect within this period that is not attributable to improper use by the customer, blinq will at its own discretion first attempt to repair the product or replace it with an equivalent item. Only if repair or replacement is impossible or disproportionate does the customer have the right to an appropriate price reduction or dissolution of the purchase.
Article 7 – Complaints and Disputes

Complaints about the execution of the agreement must be submitted within a reasonable time via info@blinqcare.com.

Belgian law applies to all agreements.

In the event of disputes, consumers within the EU have the right to submit a complaint via the Online Dispute Resolution (ODR) platform of the European Commission via the following link: europa.eu.

blinq strives for optimal and continuous availability of its webshop. However, blinq is in no way liable for direct or indirect damage resulting from temporary interruptions, malfunctions or the failure of the website, hosting services, the internet network or electronic communications, regardless of the cause. Visiting and using the website is entirely at the visitor's own risk.
Article 8 – Intellectual Property and Brand Protection

All elements of the blinq website, including but not limited to software, layout, texts, logos, brand names, product photography, campaign images with models and graphic elements, are exclusively owned by Trescom BV or are lawfully used under licence from suppliers, photographers, models and other legal rights holders. These elements are protected worldwide by applicable copyright, trademark, design rights and other intellectual property laws.

Customers, visitors or third parties are strictly prohibited from copying, reproducing, downloading, modifying or exploiting (parts of) the website, visual content, unique colour combinations or textual content for commercial purposes without the prior, explicit and written consent of Trescom BV.

Any unauthorised reproduction or misuse of our visual and textual materials is considered a direct infringement of our intellectual property rights and will immediately lead to legal action and the claiming of market-appropriate compensation.
Article 9 – Severability

If any provision of these general terms and conditions is declared unlawful, void or unenforceable by a court or competent authority, this shall in no way affect or diminish the validity, legality and enforceability of the remaining provisions. The invalid or unenforceable provision shall be deemed to have been replaced by a valid provision that most closely approximates the original intention and economic purpose of blinq.
Article 10 – No Waiver of Rights

If blinq at any time fails to enforce strict compliance with a right or a provision of these general terms and conditions, this shall under no circumstances be interpreted as a waiver of that right or provision for the future. Any deviation or exemption from these conditions is only valid if expressly and in writing confirmed by a legal representative of Trescom BV.
Article 11 – Electronic Waste Processing (WEEE & Batteries)

Electrical appliances and built-in batteries may not be disposed of with normal household waste. The customer is legally required to hand in discarded electronic blinq products free of charge at a local collection point or recycling centre in accordance with applicable national legislation (such as Recupel in Belgium or Stichting Open in the Netherlands).
